Exercising rights on questions of data protection
The Public Ports Agency of Andalusia has created a privacy policy taking into account the content of Regulation 2016/679 of the European Parliament and Council of 27 April 2016 in relation with the protection of natural persons, the processing of personal data and the circulation of these data, hereafter the RGPD, and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.
The objective is to inform the owners of personal data, whose information is being collected, the specific aspects involved in processing their data, including the purpose of this processing, the contact details to enable them to exercise their rights, the periods in which the information may be retained and the security measures, among other aspects.
This privacy policy is an integral part of the Legal Notice, so the provisions is contained shall apply directly and/or vice-versa, and shall complement each other.

3. Purpose and use of the data
The personal data is collected and processed for the following purpose:
- To provide the service requested and the administrative, commercial, tax and accounting procedures of the Agency.
- The security of users in the ports, property and personnel of the companies located there.
The Public Ports Agency of Andalusia will process your data in a legal, honest, transparent way that is appropriate, relevant, limited, precise and up-to-date. This is why we promise to adopt all reasonable measures to ensure the data is deleted or corrected immediately when they are inaccurate.
4. Legal Grounds for Processing
- When providing the requested service, the legal grounds for processing your data is the fulfilment of the contract or compliance with the law, such as the laws on taxation.
- In relation with port security, it is the fulfilment of a contract with a third party and the legitimate goal pursued by the responsible entity for processing or a third party (personnel, property and companies resident in the port area).
5. Period of Conservation
- Where a product is supplied or a service requested, your data shall be retained while the commercial relationship is active or, as long as necessary to comply with our legal obligations.
- In relation with port security, the data shall be retained for 30 days at the most, except when they are necessary to comply with a legal order. In this case, the data shall be blocked and processed exclusively in relation with the order.
6. Automated decisions and creation of profiles
There are no automated decisions, including the creation of profiles.
7. Disclosure of your data
Access to your personal details will be granted to entities related with the Public Ports Agency of Andalusia called “Data Processors”, such as: tax and accounting consultants, service providers, maintenance companies, financial entities, etc.
Your data may also be disclosed to other entities in compliance with legal obligations (such as the Tax Agency).
In relation with port security, your data may be disclosed to law enforcement agencies when they issue a formal request or a court order.
8. International data transfer
The Public Ports Agency of Andalusia does not transfer data internationally.
9. Rights
In accordance with Heading III of the RGPD, you may exercise the following rights in relation with your personal data:
- Access.
- Correction or deletion.
- Limited processing.
- Objection to processing
- Portability
- Withdrawal of consent.
Everyone has the right to obtain confirmation about whether the Public Ports Agency of Andalusia is processing personal data about them or not. They have the right to access their personal data, and to request the correction of inaccurate data or request deletion when, among other reasons, the data are no longer required for the purpose for which they were collected.
Similarly, in specific circumstances, they may request that the processing of their data be limited, in which case they shall only be retained for use in or defence against possible claims.
In some cases, and for reasons related with their particular situation, the interested parties may object to the processing of their data. In this case, the entity will cease to process them, except for pressing legitimate reasons or the use in or defence against possible claims.

If you feel that your rights have been violated in relation with the protection of your personal data, and are not satisfied in the exercise of your rights, you may submit a claim against the Supervisory Body at its web site: www.agpd.es.
10. Source of the data
The personal data we process comes directly from the user.
The category of data processed are:
- When the service is provided through a contract or not: name, surname, address, post code, location, province, NIF, email, bank details.
- In the case of port centre security: image.
