Function in relation with directly-managed ports
- In relation with the the Autonomous Community ports which the Entity manages directly, it has particular responsibility for the following functions:
- Organization, management and administration of ports and their service areas.
- Planning, projection, contracting and implementation of maintenance, conservation and repair works in the ports and port facilities, and the construction of new ports, the expansion and renovation of existing ports, when assigned or authorised by the Department of Development and Housing.
- Planning, establishment, management and administration of port services in the port service areas, offering these through management regimes that are most suitable for the public interest in each case.
- Drafting and approval of plans of the use for the service areas of the ports in accordance, at all times, with urban planning.
- Cooperation with the appropriate maritime authorities
- Propose the setting, update and review of the revenues of public ports to the relevant bodies.
- Set, update and review, in accordance with current legislation, revenue under private law
- Drafting of the port service regulations, system and enforcement and presentation of these to the head of the Department of Development and Housing for approval, and to oversee compliance, adapting the disciplinary measures and imposing the fines that they establish.
- In general, carry out the functions that are necessary to facilitate maritime port traffic and achieve profits and productivity in running the ports.
- As regards the management of the public property in the directly managed ports, the Agency is particularly responsible for:
- Granting, revoking and expiry of permits subject to non-renewable periods of less than three years, for preparing activities in the port area that do not require works or installations of any kind, and for the occupation of public property by temporary installations and the approval of specific terms and conditions for these, subject in each case to the general terms and conditions approved by the relevant authority.
- The granting, modification, revoking, reversion and expiry of concessions of public port property when the objective is the full or partial use of existing buildings, with or without alteration of the interior or exterior architecture, for a non-renewable period of less than five years, or the occupation of port property with temporary installations or property for a non-renewable period of more than three and less than five years.
- Proposals to the head of the Department of Development and Housing for grants, modifications, revoking, reversion and expiry of concessions for the occupation of public port property whose jurisdiction has not been assigned to the Entity and especially in relation with those that imply permanent works and installations for any period of time; the full or partial use of existing buildings, with or without alteration of their interior or exterior architecture for a period of more than five years, and the occupation of port property with temporary installations or property for a period of more than five years.
- Oversee compliance of the clauses and conditions imposed in the order granting concessions and permits and adopting whatever measures may be necessary for the protection and suitable management of public property in the port.
- Authorize the transfer of concessions and the constitution of mortgages and other guarantee provisions over them.
- Exercise the rights of withdrawal that legally correspond to the Autonomous Community in relation with the concessions in the ports under its jurisdiction.
- Exercise the functions of security and protection of public port property.
